This website is operated by Oh Crap Pty Ltd, ABN 91 654 369 285.
When we say "we", "us" or "our", we mean Oh Crap. When we say "you", we mean anyone who visits or buys from www.ohcrap.com.au.

By using this site or placing an order, you agree to these terms. If you don't agree, please don't use the site.

1. Who can use this site

You need to be at least 18 to place an order. If you are under 18, you can use the site with a parent or guardian's permission and they will be responsible for any order placed.

You agree not to use the site for anything unlawful, or to upload anything that could damage the site or anyone else's device.

2. Products and pricing

All prices are in Australian dollars and include GST unless stated otherwise. International customers are charged in their local currency at the equivalent of our AUD price.

Prices and product details can change without notice. We do our best to show product colours and packaging accurately, but screens vary and we can't guarantee an exact match.

We may limit the quantity of any product per order, per customer or per address, and we may decline orders that appear to be placed for resale.

3. Orders

When you place an order, you are making an offer to buy. We accept the order when we send you a shipping confirmation. We can cancel or refuse an order before that point, for example if an item is out of stock, a price was listed incorrectly, or we suspect fraud. If we cancel an order you have paid for, we will refund you in full.

You agree to give us accurate contact, billing and delivery details, and to keep them current so we can deliver your order and reach you if we need to.

4. Shipping and returns

Delivery times, costs and regions are set out in our Shipping Policy. Returns, refunds and exchanges are set out in our Refund Policy. Both form part of these terms.

5. Your rights under Australian Consumer Law

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Competition and Consumer Act 2010 (Cth) or any other law that can't be excluded.

6. Our liability

To the extent permitted by law, we are not liable for indirect or consequential loss arising from your use of this site or our products. Where the law allows us to limit our liability for a breach of a consumer guarantee, our liability is limited to replacing the product, supplying an equivalent product, or refunding the price you paid, at our choice.

We don't guarantee the site will always be available or error-free. We may change, suspend or remove any part of the site at any time.

7. Third-party links and tools

The site may link to or use third-party websites, apps or tools that we don't control. We are not responsible for their content, accuracy or availability. Any dealings you have with a third party are between you and them, so please read their terms before you proceed.

8. Reviews, comments and submissions

If you send us reviews, photos, ideas or other content, you give us permission to use, edit and publish it in any medium without payment. You confirm it is your own, doesn't breach anyone else's rights, and isn't unlawful, abusive or misleading. We can remove any submission at our discretion.

9. Intellectual property

Everything on this site, including the Oh Crap name, logo, product names, images, text and design, belongs to us or our licensors. You can't copy, reproduce or use any of it for commercial purposes without our written permission.

10. Privacy

How we collect and use your personal information is set out in our Privacy Policy.

11. Errors and omissions

Occasionally the site may contain a typo or an error in a price, description, offer or shipping charge. We can correct errors and cancel affected orders at any time, including after an order is placed. If we do, we will let you know and refund anything you have paid.

12. Prohibited uses

You must not use this site or its content to:

• Break any law or encourage anyone else to
• Infringe our intellectual property or anyone else's
• Harass, abuse, defame or discriminate against anyone
• Submit false or misleading information
• Upload viruses or malicious code
• Collect personal information about other users
• Spam, scrape, crawl or interfere with the site's security

We can suspend or terminate your access if you breach these terms.

13. Indemnity

You agree to cover any loss, claim or cost we reasonably incur because you breached these terms or the law.

14. Severability

If any part of these terms is found to be unenforceable, the rest still applies.

15. Changes to these terms

We may update these terms from time to time by posting the new version on this page. Continuing to use the site after a change means you accept the updated terms.

16. Governing law

These terms are governed by the laws of Queensland, Australia. Any dispute will be handled in the courts of Queensland, without limiting your rights under Australian Consumer Law.
